By using the services provided by Refer Appraisals, you agree to indemnify, defend, and hold harmless Refer Appraisals and its affiliates, officers, agents, employees, partners, and licensors from any claims, liabilities, expenses, and damages, including reasonable attorneys’ fees and costs, made by any third party due to or arising out of your use of the services, your connection to the services, your violation of this Agreement, or your violation of any rights of another.

Your use of the site is at your sole risk. The services are provided on an “as is” and “as available” basis. Refer Appraisals expressly disclaims all warranties of any kind, whether express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Terms and Conditions

1. Payment Terms

1.1 Referral Fees:

Members who accept referrals are responsible for paying the agreed-upon fee split. Referral fees are based on the completion of the appraisal and payment from the client. Referral fees are only owed upon the successful completion and payment of the appraisal.

1.2 Fee Structure:

• Accepting appraisers will collect the full fee from the client.
• The Appraisal Referral Network will deduct 15% of the total appraisal fee as an administrative fee.
• The referring appraiser will receive 3% for Free members or 12% for Elite members.

1.3 Payment Timeliness:

Payments to the referring appraiser and the Appraisal Referral Network are due immediately upon completion of the appraisal and receipt of payment from the client. Failure to remit the fees promptly may result in suspension or termination of membership.

1.4 Non-Payment and Collections:

If payment is not made within 30 days of receipt from the client, we reserve the right to take appropriate collection actions, including engaging third-party collection agencies or pursuing legal remedies. All costs incurred for collections will be the responsibility of the defaulting member.

1.5 Non-Payment by Clients:

If a client does not pay the appraisal fee or if the appraisal is canceled, no referral fees will be owed.

2. Membership and Referrals

2.1 Membership Levels:

• Free Membership: No monthly cost, 3% referral fee.
• Elite Membership: $20/month, 12% referral fee.

2.2 Referral Process:

Members can refer appraisals they cannot fulfill to another appraiser in the directory, with the accepting appraiser responsible for completing the assignment.

3. Referral Disbursement

3.1 Disbursement Schedule:

Referral fees are disbursed once the referral is completed and paid.

3.2 Notification:

The accepting appraiser must update the referral status and notify both the client and the referring appraiser at key stages, including acceptance and completion.

4. Non-Lender Referrals

Referrals through the Appraisal Referral Network are limited to private, non-lender appraisal requests.

5. Membership Cancellation

Members may cancel their membership at any time. If a referral is in progress, the member is responsible for completing the assignment and paying all applicable fees.

6. Termination and Suspension

We reserve the right to suspend or terminate access for non-compliance, including failure to remit referral fees, misrepresentation, or unprofessional conduct.

7. Changes to Terms and Conditions

We may update these Terms and Conditions at any time. Continued use of the platform constitutes acceptance of any changes.

8. Collection Actions for Non-Payment

8.1 Non-Payment:

If a member fails to remit referral fees within 30 days, we reserve the right to initiate collection actions.

8.2 Responsibility:

The defaulting member will be responsible for any collection costs, including legal fees and interest accrued.
